Definition of Prostitution Under Arizona Law:

Prostitution involves offering sexual services in exchange for a fee or something of value. In most cases money is exchanged between parties. In other instances there may be an item or service exchanged, whether legal or illegal, such as drugs, shelter or transportation. Sexual conduct may involve intercourse, oral sex, or other kind of sex.

Mandatory Prostitution Penalties in Arizona:

  • First prostitution offense: 15 days jail
  • Second prostitution offense: 30 days jail
  • Third prostitution offense: 60 days jail
  • Fourth prostitution offense: 180 days jail

Penalties for prostitution are complex in Arizona. If the defendant has a history of prostitution there are additional penalties that may be imposed. Additional penalties may include:

  • $2500 fine
  • Up to three years’ probation
  • Classes, counseling
  • If defendant has four prostitution offenses under Arizona state law, it converts into a class 5 felony, which carries up to minimum 180 days jail or prison/up to 2.5 years prison
